Terms of Service

1. Acceptance of Terms
By accessing or using CardHai (“Service,” “Platform,” “we,” “us,” or “our”) at cardhai.com, you (“User,” “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and CardHai, governed by the laws of India. Use of the Service signifies your acceptance of these Terms and our Privacy Policy.
2. Description of Service
CardHai is a link-in-bio platform that allows users to create and share personalised digital cards containing social media links, contact information, and a QR code. The Service includes:
- A public-facing card page at
cardhai.com/yourusername - Native deep linking to social media apps (Instagram, YouTube, WhatsApp, Spotify, etc.)
- A QR code generator for your card
- Analytics dashboard tracking card views, link clicks, and QR scans
- Tip collection via Razorpay (UPI, cards, wallets)
- Free and Pro (paid) tiers
3. User Accounts
3.1 Registration
You must sign in with a valid Google account to use the Service. You are responsible for all activity that occurs under your account. You agree to keep your Google account secure and to notify us immediately at mail.cardhai@gmail.com of any unauthorised access.
3.2 Username
Your chosen username becomes part of your public card URL. Usernames must be unique, may not impersonate real persons, businesses, or brands, and may not contain offensive or infringing content. We reserve the right to reclaim usernames that violate these rules.
3.3 Account Termination
You may delete your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice and without any obligation to issue a refund.
4. Free and Pro Plans
4.1 Free Plan
The Free plan is available at no cost and includes: 1 link card, unlimited links, basic analytics, and QR code download. Free plan features are subject to change with reasonable notice.
4.2 Pro Plan — “Lifetime” Access: Definition and Limitations
⚠️ Important: Please read this section carefully before purchasing.
The Pro plan is currently available for a one-time payment of ₹499 (subject to change for new purchases). This plan is marketed as “Lifetime” access. The following definitions and limitations apply:
- “Lifetime” is defined exclusively as the operational lifetime of the CardHai product or service — it does NOT refer to the natural lifespan of the User or any other individual. “Lifetime access” means access to Pro features for as long as CardHai, as a business and operating service, continues to exist in its current form.
- No refund obligation on service discontinuation: If CardHai ceases operations, undergoes a fundamental pivot, transfers ownership, or discontinues the Pro plan for any reason, CardHai is not legally obligated to provide continued service, a replacement service, or any monetary refund of the ₹499 one-time fee. The ₹499 payment is a one-time, non-refundable licence fee for access to Pro features during the service's operational period.
- Feature parity is not guaranteed: CardHai reserves the right to add, modify, or remove individual Pro features over time. We commit to maintaining the core value proposition of the Pro plan, but we are not obligated to provide features in perpetuity that are rendered impossible by changes in technology, third-party platforms, or applicable law.
- One account, non-transferable: The Lifetime Pro upgrade is tied to one specific CardHai account and is not transferable to another account or person.
By purchasing the Pro plan, you acknowledge and accept these terms unconditionally.
4.3 Payments
All payments are processed by Razorpay (Razorpay Software Private Limited), a PCI-DSS compliant payment gateway. CardHai does not store your card or bank details. Payments are in Indian Rupees (INR).
4.4 Refund Policy
Due to the digital nature of the Service, all payments are non-refundable once the Pro upgrade has been activated on your account. If you experience a payment issue (e.g., charged but not upgraded), please contact mail.cardhai@gmail.com within 7 days and we will resolve it promptly.
5. Third-Party Platform Dependencies
📣 Important Notice Regarding Third-Party Platforms
CardHai's core functionality — including deep linking, traffic routing, and link sharing — relies substantially on third-party platforms and services including, but not limited to: Meta (Instagram, Facebook, WhatsApp), Alphabet Inc. (YouTube, Google), Apple Inc., Spotify, Twitter/X, Snapchat, and other social media networks (“Third-Party Platforms”).
CardHai has no affiliation, partnership, or contractual relationship with these Third-Party Platforms and has no control over their policies, algorithms, technical systems, or business decisions.
CardHai expressly disclaims all liability for:
- Domain or link blocking: Any action by a Third-Party Platform to block, flag, suppress, sandbox, or blacklist CardHai's domain (cardhai.com) or any user-generated links, resulting in reduced traffic, broken links, or inaccessible cards.
- Algorithm changes: Any changes to the content recommendation, feed ranking, or link-preview algorithms of Third-Party Platforms that reduce the visibility or click-through rate of links pointing to a user's CardHai card.
- Deep link failures: Any failure of native deep links (e.g., “Open in Instagram App”) caused by updates to the operating systems (iOS, Android) or apps of Third-Party Platforms.
- Account bans or restrictions: Any suspension, ban, or restriction of a user's account on a Third-Party Platform, whether caused by or unrelated to their use of CardHai.
- Loss of revenue or traffic: Any loss of affiliate commission income, sponsorship revenue, ad revenue, follower count, views, or other commercial loss arising directly or indirectly from any action taken by a Third-Party Platform with respect to CardHai's domain or the user's content or links.
Users acknowledge that the use of link-in-bio tools on platforms like Instagram involves inherent risk that is entirely outside CardHai's control. CardHai provides the technical infrastructure to create and host your card; it does not and cannot guarantee that Third-Party Platforms will allow traffic to flow to or from your card page.
6. Tip Collection Feature
6.1 How Tips Work
Card owners may enable a “Tip” button on their card. Visitors (tippers) can pay amounts between ₹10 and ₹500 per transaction via Razorpay. Tippers do not need a CardHai account.
6.2 Platform Fee
CardHai retains 10% of each tip as a platform fee. The remaining 90% is credited to the card owner. Example: a ₹100 tip results in ₹90 to the creator and ₹10 to CardHai, before any applicable payment gateway charges.
6.3 Payouts
Tip earnings are paid out to the card owner's registered UPI ID every Sunday, subject to a minimum payout threshold. Payout limits apply (default: ₹50/day, ₹1,000/month per creator, adjustable by admin). CardHai is not liable for delays caused by your bank, UPI network, or incorrect UPI ID.
6.4 KYC and Tax
For tip payouts, you may be required to provide KYC information (PAN, Aadhaar) as mandated by Indian financial regulations. Tax deduction at source (TDS) may apply as per applicable Indian tax laws. You are responsible for reporting your tip income in your tax returns.
6.5 Tip Refunds
Tips are voluntary payments and are generally non-refundable. In case of fraudulent transactions, please contact us within 24 hours.
7. Anti-Spam, Abuse, and Prohibited Content Policy
🚫 Zero-Tolerance Policy — Immediate Termination Without Refund
CardHai operates a shared domain (cardhai.com) used by all users. Any abuse that results in our domain being blacklisted by ISPs, email providers, social networks, or search engines harms every user on the platform. Accordingly, we enforce a strict zero-tolerance policy against the following categories of abuse.
7.1 Prohibited Activities
You agree not to use the Service to link to, promote, or distribute:
- Malware, spyware, ransomware, or any malicious code — including drive-by download links or deceptive redirects.
- Phishing or social engineering content — including fake login pages, impersonation of banks, governments, or brands.
- Copyright-infringing material — pirated movies, music, software, or any content that violates the Intellectual Property rights of any third party under Indian law (Copyright Act, 1957) or international treaties.
- Illegal goods or services — including but not limited to drugs, weapons, counterfeit products, or any material prohibited under Indian Penal Code (IPC) or Information Technology Act, 2000.
- Child Sexual Abuse Material (CSAM) — any sexual content involving minors is absolutely prohibited and will be reported to law enforcement.
- Hate speech, incitement to violence, or communally sensitive content — including content that violates Sections 153A, 295A, or 505 of the IPC.
- Unsolicited bulk messaging (spam) — using CardHai links as part of SMS spam, email spam, or unsolicited social media messaging campaigns.
- Pyramid schemes, Ponzi schemes, or deceptive financial offers — including fake investment platforms or multi-level marketing fraud.
- Pornographic or obscene content — unless operating on an age-verified adult platform explicitly approved by CardHai in writing.
7.2 Enforcement Actions
Upon detection or credible report of a violation of Section 7.1, CardHai reserves the right, at its sole discretion, to take any or all of the following actions immediately and without prior notice:
- Immediate account suspension — your card will be taken offline instantly.
- Permanent account termination — your account, data, and card URL will be deleted.
- No refund — any paid amounts, including the ₹499 Lifetime Pro fee or pending tip payouts under ₹50, are forfeited without any right to reimbursement when termination is due to a violation of this Section.
- Reporting to law enforcement — we will report illegal activity to the appropriate Indian authorities, including the Cyber Crime Cell and the IT Ministry's CERT-In.
- IP and device banning — to prevent re-registration by bad actors.
CardHai does not accept appeals for terminations resulting from verified violations of Section 7.1. However, if you believe your account was terminated in error, you may contact mail.cardhai@gmail.com within 30 days to request a review.
7.3 Your Content
You retain ownership of content you upload (profile photos, bio text, links). By publishing content on CardHai, you grant us a non-exclusive, royalty-free licence to display and serve your content as part of the Service. You represent and warrant that you have all necessary rights to publish such content and that doing so does not violate any third-party rights or applicable law.
8. Intellectual Property
The CardHai name, logo, design, and software are the intellectual property of CardHai and are protected under Indian copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any CardHai intellectual property without express written permission.
The “Made with CardHai” attribution badge displayed on free cards may not be removed or obscured.
9. Service Availability, Uptime, and Maintenance
9.1 “As Is” Service
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. While CardHai strives for maximum availability and reliability, we do not guarantee 100% uptime or uninterrupted access to the Service at any time.
9.2 No Liability for Downtime
CardHai shall not be liable for any damages, losses, or costs of any kind arising from service outages, scheduled or unscheduled maintenance windows, server failures, or degraded performance, including but not limited to:
- Lost affiliate commissions or referral income — if your card was inaccessible during a period when affiliate clicks would have occurred.
- Lost advertising revenue or brand deal income — if a campaign sponsor or ad network was unable to verify your card's performance during downtime.
- Lost business or commercial opportunities — including missed sales, events, or partnerships due to temporary card inaccessibility.
- Lost social media traffic or follower growth — if downtime coincided with a viral moment or campaign.
- Loss of data — although we maintain regular backups, we cannot guarantee zero data loss in all disaster scenarios.
9.3 Maintenance Windows
We will make commercially reasonable efforts to schedule maintenance during off-peak hours (2:00 AM–5:00 AM IST) and to provide advance notice of planned outages via our support channels or status page where reasonably practicable.
9.4 Modifications to the Service
We may modify, suspend, or discontinue any feature of the Service with reasonable notice. For the Lifetime Pro plan, we commit to providing at minimum the core features listed at the time of purchase for as long as CardHai operates, subject to Section 4.2.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW.
WITHOUT LIMITING THE FOREGOING, CARDHAI MAKES NO WARRANTY THAT: (A) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) LINKS ON YOUR CARD WILL FUNCTION CORRECTLY ON ALL DEVICES, OPERATING SYSTEMS, OR THIRD-PARTY PLATFORMS AT ALL TIMES; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED WITHIN ANY SPECIFIC TIMEFRAME.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARDHAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, AFFILIATE COMMISSIONS, BUSINESS OPPORTUNITIES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
THIS LIMITATION APPLIES REGARDLESS OF WHETHER CARDHAI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE).
Our total aggregate liability to you for any and all claims arising under or related to these Terms shall not exceed the greater of: (a) the total amount you paid to CardHai in the 12 months immediately preceding the claim, or (b) ₹499 — whichever is lower.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed exclusively in accordance with the laws of the Republic of India, without regard to conflict of law principles. The following Indian laws, among others, are applicable to your use of this Service:
- The Information Technology Act, 2000 (and its amendments)
- The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
- The Consumer Protection Act, 2019
- The Indian Contract Act, 1872
- The Copyright Act, 1957
- The Payment and Settlement Systems Act, 2007
12.2 Jurisdiction
Any disputes, legal proceedings, or claims arising from or in connection with these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India. By using the Service, you irrevocably consent to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such proceeding in New Delhi.
12.3 Dispute Resolution — Good Faith First
Before initiating any formal legal proceedings, both parties agree to attempt to resolve the dispute in good faith by contacting us at mail.cardhai@gmail.com and allowing 30 days for resolution. This requirement does not apply to applications for injunctive or other equitable relief, or to claims arising from Section 7 (Anti-Spam & Abuse).
13. Indemnification
You agree to defend, indemnify, and hold harmless CardHai and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from:
- Your use of or access to the Service;
- Your violation of any term of these Terms of Service;
- Your violation of any third-party right, including without limitation any copyright, trademark, privacy, or other proprietary right;
- Any content you submit, post, or transmit through the Service;
- Your actions resulting in CardHai's domain being blacklisted, penalised, or blocked by any third-party platform, ISP, or regulatory body.
14. Age Restrictions
14.1 Minimum Age Requirement
The Service is intended for users who are 18 years of age or older. Users between the ages of 13 and 17 may only use the Service with verifiable parental or legal guardian consent. By creating an account, you represent and warrant that you meet this age requirement.
This requirement is consistent with India's Digital Personal Data Protection Act, 2023 (DPDP Act), which imposes special obligations on platforms that process personal data of children under 18. CardHai does not knowingly collect personal data from children under 13. If we become aware that a child under 13 has provided us with personal data without verifiable parental consent, we will delete such data promptly.
14.2 Parental Responsibility
If you are a parent or guardian and you believe your minor child has registered for the Service without your consent, please contact us immediately at mail.cardhai@gmail.com and we will take appropriate action, including account deletion.
15. Analytics and Visitor Data
15.1 Data Collected from Card Visitors
When a visitor (someone who is not a registered CardHai user) views your public card page atcardhai.com/yourusername, CardHai automatically collects certain anonymised technical data for the purposes of providing analytics to the card owner. This may include:
- Approximate geographic location (country/city level, derived from IP address)
- Device type, operating system, and browser/app used to view the card
- Referrer URL (the source that sent the visitor to the card)
- Number of link clicks and QR code scans
- Timestamp of the visit
Visitor IP addresses are stored only temporarily for analytics processing and are not sold, rented, or shared with any third-party advertisers.
15.2 Aggregated Analytics
CardHai may use anonymised, aggregated analytics data (e.g., “most popular link categories across all cards”) for product research, feature development, and business reporting. This data cannot be used to identify any individual user or visitor.
15.3 Card Owner Analytics Dashboard
Card owners can view their card's analytics in the dashboard. This data is private to the card owner and is not shared with other users. CardHai retains analytics data for a period of up to 12 months.
16. Coupons and Promotional Offers
CardHai may, from time to time, offer promotional discount codes or coupons (“Coupons”) for the Pro plan upgrade. The following terms apply to all Coupons:
- Single-use only: Each Coupon may be redeemed only once per account unless explicitly stated otherwise.
- Non-transferable: Coupons may not be sold, gifted, or transferred to another user or account.
- Non-stackable: Only one Coupon may be applied per transaction. Coupons cannot be combined with other promotional offers.
- Expiry: Coupons have an expiry date and will not be accepted after that date. Expired coupons cannot be reactivated.
- No cash value: Coupons have no monetary value and cannot be exchanged for cash or credit.
- CardHai reserves the right to cancel, modify, or invalidate any Coupon at any time, including in cases of suspected fraud or abuse, without prior notice or liability.
- Automated abuse: Any attempt to generate, harvest, or bulk-redeem Coupons through automated tools or scripts will result in immediate account termination without refund.
17. Force Majeure
CardHai shall not be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond CardHai's reasonable control (“Force Majeure Event”), including but not limited to:
- Acts of God, natural disasters, floods, earthquakes, or pandemics;
- Government-ordered internet shutdowns, curfews, or regulatory actions;
- Failure of third-party infrastructure providers (including Supabase, Vercel, Razorpay, Cloudflare, or any cloud hosting provider);
- Widespread internet outages or DNS failures beyond our control;
- Cyberattacks, DDoS attacks, or security incidents targeting our infrastructure;
- Labour disputes, strikes, or any other industrial action;
- War, terrorism, civil unrest, or other extraordinary events.
In the event of a Force Majeure Event, CardHai will make commercially reasonable efforts to notify users and restore the Service as quickly as practicable. No SLA credits, refunds, or compensation will be owed for downtime caused by Force Majeure Events.
18. Changes to Terms
We reserve the right to update these Terms at any time. We will provide at least 7 days' notice of material changes via email or a prominent notice on the platform. Continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
19. Miscellaneous
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CardHai regarding the Service and supersede all prior agreements and understandings.
19.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
19.3 No Waiver
CardHai's failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
19.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without CardHai's prior written consent. CardHai may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets, without notice to you.
